REGISTRATION: This is an online only auction. You will need to register online to bid and agree to all terms. By registering, all bidders acknowledge having read and agree to be bound by the Auction Terms & Conditions. IF YOU HAVE NOT READ AND REVIEWED THE TERMS FOR SALE OF REAL ESTATE, DO NOT BID.
ONLINE ONLY AUCTION: (i.e. Internet Auction) to be brokered and hosted by United Country Farm & Home Sales. The online auction and the online bidding shall begin on or before April 8th, 2022 and begin closing on April 27th, at 6 p.m. Any bid placed in the final three (3) minutes of the auction will result in automatically extending the auction by three (3) minutes from the time the bid was placed. For example: if an auction is scheduled to close at 2:00 p.m. and receives a bid at 1:59 p.m., the close time will automatically extend to 2:03 p.m. The automatic extension feature will remain active until no further bids are received within the last three (3) minutes of the online auction. BUYER PREMIUM: A Buyer’s Premium in the amount of Three Percent (3%) will be added to the final high bid to arrive at the final sales contract price. For example, a winning bid of $100,000 will be adjusted to $103,000 on the final contract to adjust the sales price for the Buyer's Premium.
SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, United Country Farm & Home Sales reserve the right to extend bidding, continue the bidding, or close the auction. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor UNITED COUNTRY FARM & HOME SALES AND/OR AGENTS AND EMPLOYEES SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON.
FINANCING: By participating in this auction, bidders hereby agree that their bid shall NOT BE SUBJECT to the bidders’ ability to obtain financing. By placing a bid in this auction, bidders understand that financing is NOT a contingency in the purchase agreement.
ACCEPTANCE OF FINAL BID: Following the close of the auction, the winning bid shall be submitted to the seller. The Sellers of the property RESERVE THE RIGHT TO APPROVE, DENY OR COUNTER OFFER ANY WINNING BID. The winning bidder hereby agrees to be contacted at the end of the auction by the auctioneer to complete an Offer to Purchase Contract. That contract will then be submitted to the Seller, and the winning bidder shall have a response from the Seller within 24 hours of the close of the sale.
PROPERTY / TITLE INSPECTION: It is recommended to all bidders to inspect the property prior to placing any bids in the auction. Property inspections are the responsibility of the bidder. Informational title work will be available online by April 15th, 2022.
DOWN PAYMENT / ESCROW: An escrow deposit of Ten Percent (10%) of the total contract purchase price must be received by Polk County Title Company in Bolivar, Missouri within 24 hours of the close of the auction. Acceptable forms of payment include cashier’s check, personal/corporate check or wire transfer. The balance will be due in full at closing.
CLOSING & CLOSING COSTS: Closing shall be on or before June 3rd, 2022 at Polk County Title Company in Bolivar, Missouri. Out of area buyers will be afforded the opportunity to close via mail and wire transfer their funds for closing. TITLE COMMITMENT shall be paid by the SELLER, and the OWNERS POLICY shall be paid by the BUYER. Seller shall deliver title in the form of a General Warranty Deed. The Buyer will be responsible for their own mortgage policies or 1031 exchange fees (if applicable). Customary closing fees in the county where the property is located will apply to both the Seller’s and Buyer’s transactions accordingly.
TAXES: 2022 Real Estate Taxes will be prorated and the cost of those shared by the Seller & Buyer at the day of closing
POSSESSION: Purchaser shall receive possession of the property at closing.
HOLD HARMLESS: Buyer and/or Bidder agrees to hold harmless and indemnify United Country Farm & Home Sales and its Agents, Owners and/or Employees and its Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
BROKER PARTICIPATION: United Country Farm & Home Sales will offer a 1% broker cooperation to any agency who brings a successful buyer to the auction. In order to receive their commission split, this agency must show their buyer the property, perform their due diligence and fill out the Buyers Agency Participation Agreement for United Country Farm & Home Sales.

PRE–AUCTION SALES: As an agent for the Seller, the Auctioneer must present any and all bona fide written offers to the Seller, which may be created outside of the online bidding platform. Therefore, all properties are subject to pre-auction sales. Any pre-auction offer will be submitted to the Seller in a timely manner, and Seller reserves the right to accept, reject or counter any offer. When/If a pre-auction offer is submitted, all properly registered online bidders will be notified that “an offer” has been submitted, however the amount of the offer shall remain confidential. In a situation where the auction involves property that is offered in multiple tracts, any pre-auction offers must be submitted for the ENTIRE property, not just any individual tract.
PROPERTY SURVEY: Subject property is currently deeded as 120 +/- acres, and acreages shown per tract are measured using GIS technology. The acreages shown are believed to be accurate in acreage amounts but are not guaranteed. The property is currently not surveyed in the manner offered for sale and will only be surveyed into the tracts shown if needed. For example, if one bidder is successful in purchasing all tracts offered, then no survey will be completed. If a bidder successfully purchases adjacent tracts, they will be surveyed as one tract, not multiple. In the event that every tract offered for sale has a different winning bidder, the tracts will be surveyed out as shown, and the cost for all survey work will be split equally between the winning bidder and Seller. Survey to be completed prior to the close of the sale, final purchase price shall be adjusted +/- as a result of final survey, if a final survey is needed to complete the sale.
