Buford Resources, Inc., (Auctioneer) will conduct this auction. Bidding is open to any properly registered adult without regard to race, color, sex, religion, or national origin. However, Seller and Broker reserve the right to qualify prospective bidders and to withdraw bidding rights of registered bidders based on conduct, financial circumstances, or other cause affecting or appearing to affect that person’s suitability, credibility, or capability as an auction participant. Broker reserves the right to modify these Terms and Conditions. Any modifications will be announced prior to the auction. Broker shall be the sole judge of the methods and procedures of the auction and for resolving any disputes. Bidder is responsible to assure that his bid and bidder number are made known to the auctioneer. By participating in this auction, Bidder agrees to be bound by these Terms and Conditions.
All Bidders must present a valid drivers’ license or comparable identification and register with Auctioneer prior to entering a bid.
Buyer's Premium: A buyer's premium of ten percent (10%) of the high bid will be added to the high bid for all bidders to determine the final sales price for the auction lot.
Sales Tax: Items will be subject to a sales tax rate of 5.25% (4.5% Oklahoma State Tax, 0.75% Grady County Tax) A bidder claiming exemption from sales tax must present proof of such exemption at the time of registration. Otherwise, all sales of personal property will be charged the applicable Oklahoma state and county tax.
Successful bidders on personal property shall settle their accounts at the time a bid is accepted or no later than the close of the day of the auction. Payments shall be by cash, cash equivalent, check, approved credit cards, or other means pre-approved in writing by Broker or Seller. Credit Card payments will be subject to a processing fee passed to the Buyer. Risk of loss passes to buyer when the items are paid for and possession is offered to the buyer. A bidder successful on more than one item or lot of personal property must close on all or, at Broker’s option, lose the right to close on any one or more items or lots. Any items not removed by the pickup deadline will be considered abandoned property. If someone other than you is picking up your auction purchases, please notify Craig at 405-833-9499 so that we can release your items to your authorized agent.
Personal property is available for inspection prior to the auction. All property is offered and sold in its “as is – as shown - where is” condition without express or implied warranties, except warranty of title as expressed in these Terms and Conditions. Bidders and Participating Brokers are responsible for conducting due diligence and an inspection of the property prior to the auction and are to rely solely upon their opinion of the property. The failure to inspect the property prior to bidding shall be considered a waiver of the desire to inspect. Auctioneer is not responsible for incorrect listing information, if any. Buford Resources, Inc. has attempted to provide accurate descriptions of all items, however, it is the bidder's responsibility to determine the condition and suitability of each lot. Printed statements or descriptions by Buford Resources, Inc. staff are provided in good faith and are matters of opinion. All sales are final. There are no returns, refunds, or adjustments.
Buyers are responsible for packing, crating and removing purchased items from the auction site. Small items that are easily hand-carried must be removed by the end of the auction. All other items must be removed by the time announced at the auction or as otherwise agreed with Seller. Items not timely removed will be sold at wholesale in the local market for buyer’s account, and Seller will retain any amount paid by buyer as liquidated damages.
CONSENT TO PHOTOGRAPHS AND RECORDINGS
Broker may take photographs or other electronic recordings and representations of events and attendees during the course of the auction that may be used in future promotions. By attending the auction, attendees, whether registered or not, consent to such activity and make no claim to or right in the materials.
CONFLICTS
If any of these Terms and Conditions conflict with the terms of the contract for the sale of the property, the terms of the contract shall control.
