Five Tracts of the Briggs & Eggers Apple Orchard in Willcox, Arizona, will go to Auction April 4, 2024. Well-established certified organic orchard now available for sale in smaller tracts.

Overview 

The orchard consists of 472.14+/- acres of deeded land and a well-improved headquarters with three homes, workshop, and 24,075+/- s.f. of processing facilities including apple sorting, washing, cold storage buildings and retail space, and a truck scale. The orchard grows a variety of apples on the majority of the 400 acres, with pears on 10 acres. The orchard is being offered in 5 tracts or can be purchased turn-key, complete with all tractors, trailers, sprayers, all rolling stock, irrigation pumps and equipment, and computerized processing equipment. This is the type of agricultural investment property that can become an important part of an investor’s portfolio for years to come. 

The property is located about 19 miles north of Willcox in Graham County, AZ. The City of Tucson and the Tucson International Airport is 93 miles west on Interstate 10 and a 90-minute drive from the property. Many people are under the impression that Arizona is a very dry and hot southern state. While some regions are indeed dry and hot, Willcox is at 4,300 feet in elevation in a wide basin that is surrounded by mountains on all sides. The average high temperature in June and July is 96 degrees; in August the average high is 93 degrees. Summer evenings average a low between 58 and 65 degrees. This wide range of temperatures is ideal for growing fruit, because the cool nights cause sugar to settle in the fruit, making for sweet, tasty produce. Consequently, many growers raise cash crops such as wine grapes, apples, pistachios, hay, and vegetables. In fact, Willcox is known for many varieties of wine grapes. Water is produced by drilling into aquifers that are fed by the nearby mountains.  Average annual rainfall is approximately 12 inches and there are on average 277 days of sunshine!

Orchard details - Varieties, Spacing, Age of Trees

The property consists of 412+/- acres of apples with the following spacings:

  • 171+/- acres planted at 12’ x 18’ spacings ( 15.5 acres in trellis)

  • 229+/- acres at 10’ x 18’ spacings

  • 11.3 +/- acres at 6’ x 18’ trellis spacings.

The majority of the apple trees were planted in the 1980’s. New plantings in 2018 and 2019 cover approximately 25% of the acreage. The younger trees are now coming into production. Most trees are planted in a traditional spacing, with trees planted to a density of about 220 trees per acre. However, 25 acres are trellised in a denser pattern pioneered on Israeli orchards that takes advantage of drip irrigation and provides labor savings at harvest time. Current production is about 2,000 to 4,000 tons annually. Currently 70% of the apples go to juice, with the balance being sold as table quality to a local Arizona produce broker and a portion are sold on site at the retail center.

Tree Varieties: The apple varieties include Granny Smith, Gala, Fuji, Red Delicious, Pink Lady, Lady in Red, Red Cameo, Sundowner, Ambrosia, and Sweetie.  Pear varieties include Bartlett, Red D'Anjou and Bosc.  Fully certified by Quality Assurance International (QAI) as an organic grower.

All the orchards are irrigated by irrigation using water pumped from an underground aquifer.  There are a total of seven irrigation wells on the property, including five existing older wells with electric turbine pumps. A sixth older well is out of service. A new well was drilled in 2022 to a depth of 2,100 feet. Static water level in this well is 400 feet with current production at 350 gallons per minute. Water quality is generally good in the area. There are three domestic wells.

Orchard Infrastructure Improvements

The Briggs & Eggers Orchard has a complete set of quality improvements with all the necessary storage and handling facilities to go to work immediately. Improvements include:

20,000 s.f. Processing/Cold Storage Building: Pre-engineered steel framed and metal processing/cold storage. Included in the cold storage/processing building: 

  • Two cold storage areas, one containing approximately 4,000+/- s.f. and the other 6,500 +/- s.f.

  • 8,000 +/- s.f. processing/packaging area with Greefa Fruit Sorter. 

  • 1,500+/- s.f. storage area

Thank you for participating in the United Country Real Estate - Stockmen’s Realty (hereinafter Stockmen’s Realty) Multi-tract Auction.  The Multi-Tract Auction and conveyance of property shall be governed by the Agreement for Purchase and Sale at auction, including all addenda, exhibits, disclosures, and other required documents (together, the “Agreement for Purchase and Sale”).  The Terms of the Sale are non-negotiable and irrevocable.  Your registration evidences your agreement with these terms.  All bidders must complete the registration process.  All bidders must  either register online on the HiBid platform or at the live Auction. By bidding you are representing to Stockmen’s Realty and the Seller that you have read and agree to be bound by all terms and conditions for this sale as stated herein.  DO NOT BID unless you have read and agreed to be bound by Agreement for Purchase and Sale, Sale Day Notes, Disclosures, and these auction Terms of Sale, as they are enforceable against you.

AUCTIONEER POWERS & AUCTION PROCESS:  The property will be offered in multiple tracts.  The highest bidder(s) at the end of the process will be the successful bidder.  The Auctioneer reserves the right to regulate bidding, to accept or reject any or all bids, and to cancel or re-schedule an auction.  The Auctioneer is the sole arbiter and controller of the conduct of the auction and shall be the final and absolute authority without liability to any party.

Should technical issues arise with the server, software provider, software, or any other online auction difficulties, Stockmen’s Realty reserves the right to extend the auction, reschedule the auction, extend the bidding, close the bidding or any other remedy deemed proper by the auctioneers.  Neither the auction company, nor any of its service providers shall be held liable, or responsible, for any missed bid or failure of any of the software to function as designed. United Country Real Estate – Stockmen’s Realty may send email notifications to properly registered bidders with updated information deemed necessary at their sole discretion.

INTERNET BIDDING:  It is the sole responsibility of the Internet bidder to be familiar with the Internet bidding process.  Live internet bidders are advised to have a DSL or higher internet connection to bid during the live auction.  Because of the fast paced nature of the auction, a slower internet connection could lead to not being able to bid.

AUCTION CLOSING PROCESS:    Auctioneer is the sole arbitrator of the closing process of this auction.

SUBJECT TO SELLER ACCEPTANCE:  This property is being sold subject to Seller confirmation within one (1) hour of the conclusion of the Auction.  The Seller reserves the right to accept or reject any and all bids.

SUBJECT TO PRIOR SALE:  The property is subject to sale prior to the Auction date.  Any such sale shall be subject to the 10% Buyer’s Premium.

PURCHASE CONTRACT:  The successful bidder shall execute an Agreement for Purchase and Sale, immediately after being declared the Successful Bidder by the Auctioneer.

DOWN PAYMENT: The successful bidders will be required to make a non-refundable deposit in the amount of ten percent (10%) of the total purchase price which shall be considered a down payment and credited to the purchase price.   Once the Seller approves the Sale, the downpayment, must be paid by the successful bidder by direct wire transfer to Pioneer Title Agency, Inc., 363 W. 4th Street, Benson, AZ  85602, Kimberly Lockhart as Escrow Agent on the Friday following the Auction by 4:00 p.m. AZ Time.  The deposit shall be non-refundable; your bidding is NOT conditional upon financing or inspection, ensure that you are prepared to pay cash at closing or have arranged financing prior to bidding.    

CLOSING OF ESCROW:  The balance of the purchase price, and Buyer’s 10% Premium (Buyer’s Fee), are due at closing by wire transferred funds on or before May 6, 2024 to the Escrow Agent.  Final closing is NOT contingent upon financing.  Closing costs will include customary escrow fees which will be paid by the Buyer and Seller equally, recording fees, tax proration’s, water and septic transfer fees, financing fees and any other fees noted.   The property will be conveyed by General Warranty Deed and Seller shall provide Buyer with an Owner’s Policy of Title Insurance at closing.  Closing will take place at the office of Pioneer Title Agency, Inc., 363 W. 4th Street, Benson, AZ  85602, Kimberly Lockhart, Escrow Officer by 5:00 p.m., Monday, May 6, 2024.

BUYER’S PREMIUM (BUYER’S FEE): Buyers shall pay a buyer’s premium equivalent to 10% of the purchase price.  The Buyer’s Premium shall be added to the final bid price and will be collected at closing.

AGENCY DISCLOSURE: Stockmen’s Realty, and all other licensees employed by or associated with the Broker exclusively represent the Seller in the sale of this property.

BUYER’S AGENT COMPENSATION: Buyer’s agents will enter into a co-broker’s agreement with Stockmen’s Realty.  Stockmen’s Realty agrees to pay upon closing a fee equal to 2% of the high bid price paid by his or her client excluding the Buyer’s Premium.   In order to be eligible for compensation, the buyer’s agent must hold an active real estate license in the State of Arizona or possess a valid real estate license and act in conformance with the laws for paying a referral fee to an out of state broker as promulgated by the State of Arizona and must register the client 24 hours prior to the auction.  All out of state brokers must provide a copy of a valid real estate license in the state of licensure prior to payment.  All registration letters shall be sent to Nancy Belt, at Stockmen’s Realty and an acknowledgement will be sent to the Agent.   No oral registrations will be accepted.  No agency relationship will be recognized for a client who has previously contacted or been contacted by the Seller, or the Seller’s Agents.  If an Agent has not met all of these requirements, no compensation will be paid, even if the Agent’s client purchases the property.

CLOSING DATE:  The closing date for parcels shall be on or before Monday, May 6, 2024 at 5:00 p.m.

POSSESSION:  Buyers are not allowed possession until close of escrow (transfer of funds and recording of the deed), at which time it is recommended that the property be re-keyed.
