TERMS & CONDITIONS
Method of Sale: Online ONLY Auction with bidding open February 23, 2026 at 11:00 a.m. and shall close on March 19, 2026 at 11:00 a.m. If accepted by the seller, closing shall be complete on or before April 21, 2026 at Trenton Abstract & Title Company, LLC located at 910 Main St., Trenton, MO 64683.
Bidding: Bidding will end with a soft close, meaning that a bid in the final minutes will extend the bidding by approximately 5 minutes. With farms being joining in location, the auction will be linked, meaning all eight (8) tracts will extend by five (5) minutes if any one track has a bid on it in the last minute.
Survey: A survey will be completed for Tracts 1-6 prior to closing to determine exact acres and the purchase price will reflect the surveyed acres. Tracts 7-8 will be sold on a taxed acres basis.
Fences: Any and all boundary lines that need fenced will be the responsibility of the new owner.
Highest Bidder/Earnest Money: The successful high bidder, upon completion of the Real Estate Auction, must complete and sign a purchase agreement and render 10% of the purchase price (earnest money) as a non-refundable deposit in the form of a personal check, business check, certified funds, or wire payable to the closing company. Balance will be due at final closing.
Possession: The buyer will receive possession at closing. EXCEPTION: Tract 2- The metal building located on Tract 2 (E. 320th Ave.) will be available to the seller until July 20, 2026 to get any and all personal belongings out.
Purchase Agreement: United Country Nelson Real Estate & Auction Company must receive a signed copy of the contract (hand delivered, faxed, scanned, emailed, Docusgined) within 24-hours after the buyer has been notified that the sellers have accepted his or her bid.
Sold Subject To Seller Confirmation: The seller(s) shall have the right to accept or reject any and all bids. Once accepted, this agreement shall be binding on the parties and their successors and assigns. Property will not be considered sold, and all bids will be treated as offers on property, until the purchase agreement is fully executed by all parties with earnest money deposited.
Contingencies: This agreement is NOT subject to financing, inspections, or other contingencies or delays to the closing for such reason. Buyer must secure their own necessary financing approval prior to the auction
Out of Area Personal Checks: Must be with the approval of the Auction Company personnel. Anyone not known by the Auction Company or sellers may be required to show proof of Bank Letter or Credit.
NON CONTINGENT: The sale is non-contingent; failure to close will result in forfeiture of the earnest money.
The property is being sold “AS IS, WHERE IS”: The property is being sold “As Is, Where Is” and no warranty or representation, either expressed or implied concerning the property is made by the seller or Auction Company. Please inspect the property before bidding.
Homes on Property: There is a ranch home located on Tract 1 built prior to 1978. Sellers will furnish Lead Base Paint Disclosure required by federal law for anything built prior to 1978. There is a manufactured home on Tract 5 set in 2002. Seller makes make no guarantee or warranty on the homes/outbuildings condition or functioning of systems, or suitability for purchaser's intended use.
Tract Acres: Seller and or the auction company DO NOT guarantee acres.
Taxes: shall be prorated to the date of closing.
CRP payments: (Tract 7 & 8) The buyer hereby agrees to assume the existing CRP contract and to forever thereafter hold the sellers harmless from any and all claims arising out of the buyer’s failure to perform as per the terms of said CRP contracts. 2025- 2026 CRP payment shall be prorated to the date of closing by the FSA Office.
Mineral Rights: The sale shall include all mineral rights owned by the seller if any. The property is sold based on the legal description.
